General Terms and Conditions
1. Scope of Application
These terms and conditions apply to all contracts between KidsMenü (Gum and Fun Süd GmbH & Co. KG) and businesses as defined by § 14 BGB (German Civil Code). We do not sell to consumers via this shop.
2. Conclusion of Contract
The presentation of products in our shop does not constitute a binding offer. By submitting an order, you are making a binding offer. The contract is concluded upon our order confirmation or upon dispatch of the goods. The automatic email confirmation of receipt does not yet constitute acceptance.
3. Prices and Payment
All prices are net, exclusive of statutory VAT and shipping costs. Payment is due on invoice within 14 days from the invoice date without deduction, unless otherwise agreed.
4. Delivery
Delivery will be made to the specified practice or company address within Germany. Stated delivery times are non-binding estimates. Partial deliveries are permissible, provided they are reasonable for you.
5. Retention of Title
The goods remain our property until full payment has been received.
6. Warranty
The statutory warranty regulations for commercial sales apply, including the obligation to inspect and notify defects as per § 377 HGB (German Commercial Code). We provide a 24-month warranty on the vending machine mechanics from the delivery date.
7. Returns Policy
There is no statutory right of withdrawal for business-to-business transactions. Returns of unopened goods are possible within 14 days after prior agreement. Individually branded vending machines are excluded from return.
8. Final Provisions
German law applies. The place of jurisdiction is Bayreuth, to the extent legally permissible. Should individual provisions be invalid, the remainder of the contract remains effective.
9. Liability
We are liable without limitation for intent and gross negligence, as well as for injury to life, body, and health. In cases of simple negligence, we are only liable for the breach of an essential contractual obligation and limited to the typical, foreseeable damage. Liability under the Product Liability Act remains unaffected.
10. Contract Text and Language
The contract is concluded in German. We store the order text and will send you the order data and invoice by email; the order can also be accessed in the "My Practice" section.
